Florida State v ClemsonAfter waiting weeks for a decision, Florida prosecutors have decided to not charge Jameis Winston with sexual assault.  He was facing charges after a former Florida State student told police that she was raped and said Winston was her attacker.

The case was very unsettling to begin with.  Originally the victim did not want to pursue charges, but after media attention, the case was reopened.  Winston’s DNA was found on the woman’s underwear, but his attorney said that they did not deny that the pair did not have sexual relations, but it was consensual.  Alcohol also played a major role in this case with the victim saying she had a very fuzzy memory of the night of her attack.

Winston has yet to speak on the allegations publicly, but he is expected to hold a press conference with his attorney later today.  State attorney William Meggs will also speak shortly.

Meggs said that his decision and timing had nothing to do with football nor the Heisman award.  He also said that an unknown DNA sample was found in the woman’s rape kit along with Winston’s DNA.  The toxicology report, which was done at an unknown time, did not support claims that the woman was drunk at the time of the incident.  It does not mean she was not drunk because the time of blood test has not been revealed.
